Brasilia – Based on a Supreme Court ruling in December last year that seats in the Chamber of Deputies belong to parties, not coalitions, justice Marco Aurélio Melo has just issued an injunction seating Severino de Souza Silva (PSB-PE) in the vacancy created when Danilo Cabral (PSB-PE) left to head the Pernambuco state Secretariat of Cities. This is the fourth such case in which the Supreme Court has ruled that when a deputy vacates a seat it should go to the most-voted candidate from the same political party (the official position taken by the Chamber of Deputies is that the most-voted candidate from the coalition should get the seat). There are 12 other similar cases on the court’s docket at this moment.
